Every work on Jewish thought and law since the twelfth century bears the imprint of Maimonides. A.N. Whitehead's famous dictum that the entire European philosophical tradition 'consists of a series of footnotes to Plato' could equally characterize Maimonides' place in the Jewish tradition. The critical studies in this volume explore how Orthodox rabbis of different orientations--Shlomo Aviner, Naftali Zvi Yehudah Berlin (Netziv), Kalonymus Kalman Shapira, Joseph Kafih, Abraham Isaac Kook, Aaron Kotler, Joseph Soloveitchik, and Elhanan Wasserman--have read and (...) provided footnotes to Maimonides in the long twentieth century. How well did they really understand Maimonides? And where do their arguments fit in the mainstream debates about him and his works? Each of the seven core chapters examines a particular approach. Some rabbis have tried to liberate themselves from the influence of his ideas. Others have sought to build on those ideas or expand them in ways which Maimonides himself did not pursue, and which he may well not have agreed with. Still others advance patently non-Maimonidean positions, while attributing them to none other than Maimonides. The Eleatic philosophers argued that it was impossible for anything to change, since that would require something to differ from itself. Although this line of reasoning is unpersuasive, it challenges us to provide an account of temporal predication, which is the focus of much recent work on change. This paper surveys various approaches to change and temporal predication and addresses related questions about identity, persistence, properties, time, tense, and temporal logic.

What is the best question to ask an omniscient being? The question is intriguing; is it also paradoxical? We discuss several versions of what Ned Markosian calls the paradox of the question and suggest solutions to each of those puzzles. We then offer some practical advice about what do if you ever have the opportunity to query an omniscient being.

This commentary validates the fundamental evolutionary interconnection between the emergence of imitation and the mirror system. We present a novel computational framework for studying the evolutionary origins of imitative behavior and examining the emerging underlying mechanisms. Evolutionary adaptive agents that evolved in this framework demonstrate the emergence of neural “mirror” mechanisms analogous to those found in biological systems.

It gives, within the limits of the information available, a full presentation of the life and personality of Spinoza; ample information about the different milieus in which Spinoza grew up and lived; (...) about the vicissitudes of the public life which marked his life and work; about the ways in which Spinoza's work evolved and, although it is not meant to be an "intellectual biography" (xiii), a general description of his thought. It is a welcome addition to the growing literature on Spinoza.The book begins with the story of the Jewish Portuguese community of Amsterdam, constituted by former Maranos who emigrated from the Iberian peninsula. Becoming in a very short time a flourishing community, it was unique in many ways, and the author nicely shows this. He explains how it had to rebuild its Judaism practically ex nihilo, and how this fact caused many of the inner tensions and rifts that marked its history. Nadler tells minutely the way that led to Spinoza's famous excommunication and the roles played by the main personalities involved in this dramatic event, which was not only a rupture with the community, but actually with Judaism in general.The author proceeds to examine the life of Spinoza outside the Jewish community. It makes manifest that an enormous amount of work has been done on these topics in this century and particularly in the last twenty years or so. Nadler succeeds—this is certainly a tour de force—in integrating this enormous amount of material into a coherent whole in which he also manages to keep the right amount of literary fluency and readability. Not the least of the book's merits is that it is never boring.Although I would recommend the book without any reservation to anyone who is interested in Spinoza—both beginners and veterans—I must make two brief critical remarks: 1. There seems to be some bias in favor of the Jewish background of Spinoza. Sure enough, the book is divided into two almost exactly equal parts which recount, respectively, Spinoza's life before and after the cherem (which, as a matter of fact, divides his short life into more or less equal parts). The book addresses the representation of three groups of "others" in Israeli schoolbooks: Holocaust victims, presented as the stateless persecuted Jews "we" might become again if "we" lose control over the second group of "others" - Palestinian Arabs - who are racialized, demonized and Nazified, and presented as "our" potential exterminators. The third group comprises non-European (Mizrahi and Ethiopian) Jews, portrayed as backward people who lack history or culture, requiring constant acculturation by "Western" Israel. Thus, a rhetoric of victimhood and (...) power evolves, and a nationalistic interpretation of the "never again" imperative is inculcated, justifying the Occupation and oppression of Palestinians and the discrimination of non-European Jews. Advocating a multidirectional memory, the book proposes an alternative Hebrew-Arabic, multi-voiced and poly-centered curriculum that would relate the untold accounts of the people whom the pedagogic version of history seeks exclude. Instead of traumatizing and urging vengeance, it will encourage discussion and celebrate diversity and hybridity. (shrink)

This article is written in the memory of Marcelo Dascal, and is conceived as an imaginary answer to a question put by him to the author: what is the point – given a shared non-religious, even atheistic, outlook – in translating (into the Hebrew) of Leibniz’s Théodicée? The two main theses of this imagined answer are: 1. That there is in the Théodicée a moral theory, partly implicit but irreducible and relatively independent of its theological content, and that this theory (...) is based on a paradoxical – but original and important – concept of moral necessity, extracted from the theory of the absolute need to choose the best possible; 2. That this concept of moral necessity may be developed into a theory of responsibility, looking back to the need to give accounts about what has been done (or not done), and forward, to what has to be done (or not) now. Ryan Wasserman explores a range of fascinating puzzles raised by the possibility of time travel, with entertaining examples from physics, science fiction, and popular culture, and he draws out their implications for our understanding of time, tense, freedom, fatalism, causation, counterfactuals, laws of nature, persistence, change, and mereology.

Our purpose in this article is to identify and suggest resolution for two core problematics of grounded theory. First, while grounded theory provides transparency to one part of the conceptualization process, where codes emerge directly from the data, it provides no such systematic or transparent way for gaining insight into the conceptual relationships between discovered codes. Producing a grounded theory depends not only on the definition of conceptual pieces, but the delineation of a relationship between at least two of those (...) pieces. Second, the conceptualization process of grounded theory is done in hierarchical fashion, where individual codes emerge from the data but then are used to generate insight into more general concepts and thematic statements. But various works on grounded theory have failed to provide any systematic way of using data specific levels of scale (the codes) to gain insight into more macro levels of scale (concepts and themes). We offer fractal concept analysis as a means of resolving both of these issues. By using a logic structure generator, fractal concept analysis delineates self-similar conceptual frameworks at various levels of abstraction, yielding a method for linking concepts together within and between levels of scale encountered in the grounded theory coding and categorization process. We conclude that this fractal analytic technique can bolster the aims of grounded theory as a formalized and systematic process for generating theory from empirical data. (shrink)

This book analyzes three often-debated questions of Spinoza's legacy: was Spinoza a religious thinker? How should we understand Spinoza's mind-body doctrine? What meaning can be given to Spinoza's notions - such as salvation, beatitude, and freedom - which are seemingly incompatible with his determinism, his secularism, and his critique of religion. Through a close reading of often-overlooked sections from Spinoza's Ethics, Elhanan Yakira argues that these seemingly conflicting elements are indeed compatible, despite Spinoza's iconoclastic meanings. While procreation is ubiquitous, attention to the ethical issues involved in creating children is relatively rare. In Debating Procreation, David Benatar and David Wasserman take opposing views on this important question. David Benatar argues for the anti-natalist view that it is always wrong to bring new people into existence. He argues that coming into existence is always a serious harm and that even if it were not always so, the risk of serious harm is sufficiently great to make procreation (...) wrong. In addition to these "philanthropic" arguments, he advances the "misanthropic" one that because humans are so defective and cause vast amounts of harm, it is wrong to create more of them.David Wasserman defends procreation against the anti-natalist challenge. He outlines a variety of moderate pro-natalist positions, which all see procreation as often permissible but never required. After criticizing the main anti-natalist arguments, he reviews those pronatalist positions. He argues that constraints on procreation are best understood in terms of the role morality of prospective parents, considers different views of that role morality, and argues for one that imposes only limited constraints based on the well-being of the future child. He then argues that the expected good of a future child and of the parent-child relationship can provide a strong justification for procreation in the face of expected adversities without giving individuals any moral reason to procreate. African American distrust of medicine has consequences for treatment seeking and healthcare behaviour. Much work has been done to examine acute events that have contributed to this phenomenon and a sophisticated bioethics discipline keeps watch on current practices by medicine. But physicians and clinicians are not the only actors in the medical arena, particularly when it comes to health beliefs and distrust of medicine. The purpose of this paper is to call attention not just to ethical shortcomings of the past, (...) but to the structural contexts of those events and the contributions and responsibilities of popular media and academic disciplines in the production of knowledge. We argue that ignoring context and producing inaccurate work has real impacts on health and healthcare, particularly for African Americans, and thus engenders ethical obligations incumbent on disciplines traditionally recognised as purely academic. In De veritate I.2, Thomas Aquinas claims that “to every true act of understanding there must correspond some being and likewise to every being there corresponds a true act of understanding.” For Aquinas, the ratio of truth consists in a conformity between intellect and being. This account of truth, however, doesnot appear to allow for a certain class of truths, namely those that are about nonbeings. Many think that it is true that ‘no chimeras exist,’ that ‘blindness can becaused by (...) exposure to bright lights,’ and that ‘evil should be avoided.’ Yet, in each of these cases of truth, there does not appear to be a being to which the intellectconforms. In this paper, I will explore the ways in which Aquinas’s notion of truth as “conformity to being” is able to accommodate truths about nonbeings. (shrink)

This paper critically engages ethical issues in the allocation of novel, and potentially costly, health care resources to patients with disorders of consciousness. First, we review potential benefits of novel health care resources for patients and their families and outline preliminary considerations to address concerns about cost. We then address two problems regarding the allocation of health care resources to patients with disorders of consciousness: (1) the problem of uncertain moral status; and (2) the problem of accurately measuring the welfare (...) burdens these resources would relieve. We conclude by suggesting that opportunity-based frameworks might complement standard approaches for justifying resources allocation to patients with disorders of consciousness. (shrink)

Previous theories of the relationship between dispositions and conditionals are unable to account for the fact that dispositions come in degrees. We propose a fix for this problem that has the added benefit of avoiding the classic problems of finks and masks.

Analyses of dispositional ascriptions in terms of conditional statements famously confront the problems of finks and masks. We argue that conditional analyses of dispositions, even those tailored to avoid finks and masks, face five further problems. These are the problems of: (i) Achilles' heels, (ii) accidental closeness, (iii) comparatives, (iv) explaining context sensitivity, and (v) absent stimulus conditions. We conclude by offering a proposal that avoids all seven of these problems.

Disability and enhancement are often treated as opposing concepts. To become disabled in some respect is to move away from those who are enhanced in that same respect; to become enhanced is to move away from the corresponding state of disability. This chapter examines how best to understand the concepts of disability and enhancement in this symmetrical way. After considering various candidates, two types of accounts are identified as the most promising: welfarist accounts and typical-functioning accounts. Assume that, even with a time machine, Tim does not have the ability to travel to the past and kill Grandfather. Why would that be? And what are the implications for traditional debates about freedom? We argue that there are at least two satisfactory explanations for why Tim cannot kill Grandfather. First, if an agent’s behavior at time _t_ is causally dependent on fact _F_, then the agent cannot perform an action (at _t_) that would require _F_ to have not (...) obtained. Second, if an agent’s behavior at time _t_ is causally dependent on fact _F_, then the agent cannot perform an action (at _t_) that would prevent _F_ from obtaining. These two explanations have distinct upshots for more traditional debates over freedom. The first implies that causal determinism is incompatible with the ability to do otherwise and also raises questions about the traditional arguments for the incompatibility of divine foreknowledge and the ability to do otherwise; the second does neither. However, both explanations imply that the Molinist account of divine providence renders agents unable to do otherwise, at least in certain circumstances. (shrink)

Pediatric intervention principles help clinicians and health-care institutions determine appropriate responses when parents’ medical decisions place children at risk. Several intervention principles have been proposed and defended in the pediatric ethics literature. These principles may appear to provide conflicting guidance, but much of that conflict is superficial. First, seemingly different pediatric intervention principles sometimes converge on the same guidance. Second, these principles often aim to solve different problems in pediatrics or to operate in different background conditions. The potential for convergence (...) between intervention principles—or at least an absence of conflict between them—matters for both the theory and practice of pediatric ethics. This article builds on the recent work of a diverse group of pediatric ethicists tasked with identifying consensus guidelines for pediatric decision-making. (shrink)

Conditioning can make imprecise probabilities uniformly more imprecise. We call this effect "dilation". In a previous paper (1993), Seidenfeld and Wasserman established some basic results about dilation. In this paper we further investigate dilation on several models. In particular, we consider conditions under which dilation persists under marginalization and we quantify the degree of dilation. We also show that dilation manifests itself asymptotically in certain robust Bayesian models and we characterize the rate at which dilation occurs.

New fetal therapies offer important prospects for improving health. However, having to consider both the fetus and the pregnant woman makes the risk–benefit analysis of fetal therapy trials challenging. Regulatory guidance is limited, and proposed ethical frameworks are overly restrictive or permissive. We propose a new ethical framework for fetal therapy research. First, we argue that considering only biomedical benefits fails to capture all relevant interests. Thus, we endorse expanding the considered benefits to include evidence-based psychosocial effects of fetal therapies. (...) Second, we reject the commonly proposed categorical risk and/or benefit thresholds for assessing fetal therapy research. Instead, we propose that the individual risks for the pregnant woman and the fetus should be justified by the benefits for them and the study’s social value. Studies that meet this overall proportionality criterion but have mildly unfavorable risk–benefit ratios for pregnant women and/or fetuses may be acceptable. (shrink)

Nocebo effects occur when an adverse effect on the patient arises from the patient's own negative expectations. In accordance with informed consent, providers often disclose information that results in unintended adverse outcomes for the patient. While this may adhere to the principle of autonomy, it violates the doctrine of “primum non nocere,” given that side-effect disclosure may cause those side effects. In this article we build off previous work, particularly by Wells and Kaptchuk and by Cohen :3–11.[Taylor & Francis Online], (...) [Web of Science ®] [Google Scholar]), to suggest ethical guidelines that permit nondisclosure in the case when a nocebo effect is likely to occur on of the basis of nonmaleficence. We accept that that autonomy vis-à-vis informed consent must be forestalled, but salvage much of its role by elaborating a practical clinical approach to postencounter follow-up. In doing so, we reconcile a clinically practicable process of determining conditions of disclosure with long-standing ethical commitments to patients. (shrink)
